You further agree that you will use CrewWatcher only as intended and will follow all instructions concerning its proper use and will adhere to all warnings associated with the product. CrewWatcher should be considered an aid to safe boating. It should not be considered a safety or rescue product. Sailing or boating is an inherently dangerous endeavor and it is imperative that you follow all federal and state boating regulations when operating a vessel. In the event that an occupant of a vessel properly using CrewWatcher goes overboard there is no guaranty that the occupant will be successfully rescued.

Disclaimer of Implied Warranties. SELLER DISCLAIMS ALL IMPLIED WARRANTIES AND SIMILAR OBLIGATIONS INCLUDING BUT NOT LIMITED TO THOSE OF FITNESS FOR A PARTICULAR PURPOSE, AND MERCHANTABILITY, WHETHER OTHERWISE ARISING BY LAW, CUSTOM, USAGE, TRADE PRACTICE, COURSE OF DEALING, OR COURSE OF PERFORMANCE. There are no warranties which extend other than those express warranties contained on our website or within the packaging of this product. Weems Plath does not warrant CrewWatcher will comply with the requirements of any safety code, rule or regulation of any federal, state, local government or other jurisdiction other than those express warranties in the Agreement.

Weems Plath will not be liable to any person using CrewWatcher in the event of injury or death for compensatory, punitive, incidental, consequential or other damages and Weems Plath assumes or undertakes NO LIABILITY for any loss or damage suffered as a result of the use, misuse or reliance on CrewWatcher.
